Regulatory FrameworkThe FORA ESCA Remediation Program complies with the regulatory guidelines established by the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) commonly referred to as "Superfund". CERCLA regulations provide the regulatory framework for remediation and community involvement activities. Specific regulatory requirements for the ESCA Remediation Program are in the following documents:
The Technical Specifications and Requirement Statement (TSRS) identifies the general specifications to be conducted by FORA under the ESCA Remediation Program. This includes providing environmental services for the identification, characterization, and removal of unexploded ordnance, addressing environmental scheduling and regulatory issues, and assuming liability and responsibility for regulatory closure of the ESCA parcels. FORA has entered into an Administrative Order on Consent (AOC) with the U.S. Environmental Protection Agency (EPA) and California Department of Toxic Substances Control (DTSC) that governs the remediation process. The AOC ensures compliance with all regulatory requirements under CERCLA and for the cleanup of munitions. The AOC identifies specific tasks required to complete closure of the ESCA parcels, including the regulatory documents required under CERCLA.
